DEFENDANTS accused of drug-related “date-rape” will have to prove that their victim consented to sex under a government proposal announced yesterday. David Blunkett said it would be automatically assumed that a victim did not consent to sex if a defendant knew they had been given a substance without their consent. On the amendment to the Sexual Offences Bill, the Home Secretary said: “Rape is a terrible crime, which deeply affects the lives of victims and their families and we are determined to crack down on people who drug their victims in order to force sex on them.
“The law must be absolutely clear that intimate sexual acts should only take place with the agreement of both parties.”
There has been growing concern about date-rape drugs. In June the Government banned the drug GHB, which was linked to a number of cases. It is a stimulant in small doses, but larger amounts produce an anaesthetic effect that can cause coma and even death.
The government move was welcomed by the Roofie Foundation, named after the street name for the drug, which runs a drug-rape helpline. It said that 5,500 people had rung the helpline in eight years.
